Uso y abuso del crédito de horas por los representantes de los trabajadores

El artículo realiza un exhaustivo recorrido por los pronunciamientos judiciales que abordan la correcta o incorrecta utilización de esta garantía puesta a disposición de los representantes de los trabajadores. El legislador dispone este crédito horario para su empleo en funciones sindicales o representativas, sin mayor determinación. Su contenido se presenta, pues, como multiforme por lo que corresponde acudir a los ejemplos proporcionados por los distintos Tribunales para extraer las reglas generales respecto a la actividad a realizar durante el crédito horario, el lugar de la misma, el control debido por el empresario, los supuestos límite respecto a su abuso y. en fin, la sanción correspondiente en cada caso.

For this reason, it is necessary to attend to the examples provided by the various courts to draw the general rules regarding the activity performed during the paid time off, the place of it, the control by the employer, the issues about it and the appropriate sanction in each case.
