Italy’s proposal on holocaust denial in a comparative perspective

David Irving, a British historian, was recently sentenced to three years in prison after being found guilty of presenting and giving out material denying the Holocaust. In October 2006, the French National Assembly adopted a bill making it a crime to deny that the Armenians suffered genocide at the hands of the Turks in 1915. Iran recently organised a conference which brought together a number of well-known academics who claim that the Nazi genocide of the Jews during the second world war never happened. Denial of the Holocaust is not new, and the use that is being made of it by the Iranian Government is not original, nor relevant from a legal point of view. President Ahmadinejad is clearly using this issue merely for political purposes and his declarations are similar to those of other political leaders of the past. At the beginning of 2007, the Italian Minister of Justice Mastella signed a draft bill so as to make the denial of the Holocaust a crime. Part of Italian public opinion fiercely criticised this proposal accusing the Government of attempting to illegitimately limit freedom of expression. The draft bill was then amended in Parliament, and the crime of denial of the Holocaust was not specifically introduced.
