La constitution française de 1958 et les droits fondamentaux. quelle influences?

La V República Francesa ha sido la primera en convertir a las garantías de los derechos fundamentales en un objeto del Derecho Constitucional positivo francés. Dicho desarrollo de estas garantías se debe en gran medida al papel del Consejo Constitucional. Los derechos fundamentales reconocidos en la Constitución de 1958, así como su sistema de protección, han sufrido innumerables influencias ; algunas de ellas son, la propia Decalración de Derechos del Hombre y del Ciudadano de 1789 (al igual que ésta sirvió de referencia en distintas Constituciones), las Constituciones europeas y estadounidense, el Derecho Comunitario e internacional.

The V French Republic has been the first to convert the fundamentals rights guaranties in a positive French Constitutional Right. The fundamental right acknowledged in the 1958 Constitution and its protection system have suffered lots of influences, some of them are the Rights Declaration, the Citizen Declaration of 1789 (this also was used as a reference in several Constitutions), the European and American Constitutions, the Union European Law and the International Law.
