Dolo y significado

De no ser más admisible al dolo una concepción jurídico penal traducida en una realidad ontológica, gana fuerza el fundamento normativo de la imputación subjetiva dolosa. Pero, el problema fundamental del reconocimiento del dolo como imputación parece ser un problema de legitimación. El establecimiento de criterios para la atribución del carácter doloso a una realización depende, pues, de una justificación cuyos fundamentos sean correspondientes a determinados presupuestos irrenunciables: las garantías fundamentales del Estado democrático de Derecho. Sólo es posible obtener una atribución dolosa obediente a tales garantías en un proceso de imputación cuya teoría de base se justifica a través de la inclusión del otro. Como consecuencia, el proceso de comunicación que deriva de la Filosofía del lenguaje, parece ser la mejor elección para fundamentar el significado del dolo en la teoría del delito. Este artículo trata de discutir la validez y legitimidad de tal fundamentación.

Single it is possible to obtain a obedient dolosa attribution to such guarantees in an imputation process whose theory of base is justified through the inclusion of the other. Like consequence, the communication process that derives from the Philosophy of the language, seems to be the best election to base the meaning of the dolo on the theory of the crime. This articulate tries so to discuss to the validity and legitimacy of that basis.
