Causalidad, determinismo e incertidumbre científica en el derecho penal
En este trabajo se expone cómo el conocimiento científico, y en ocasiones también la incertidumbre científica, pueden influir en el Derecho Penal. En concreto, se vuelve a la cuestión de la causalidad en diversos planos y con consecuencias diferentes. Si bien no se puede prescindir de ella, en particular en los delitos de resultado material, no ha de olvidarse que después vienen las fases de imputación objetiva y subjetiva. Además de la causalidad tradicional, de base newtoniana y determinista, se menciona otra causalidad, cuántica y probabilista, y el encaje que podría tener en el Derecho Penal. Por otro lado, se hace referencia a las objeciones que suscita el principio de precaución en el Derecho Penal, al tomar como hipótesis la incertidumbre científica sobre el acontecer causal. Se aborda brevemente la importante cuestión del determinismo en el comportamiento humano, terminando con algunas reflexiones sobre el método interdisciplinar en Derecho Penal.
This contribution deals with how scientific knowledge and at times scientific uncertainty can influence Criminal Law. Particularly, it goes back to deal with the issue of causation in different levels and with different consequences. Although we can not do without it, specifically in offences of a material result, we mustn’t forget that the phases of objective and subjective imputation follow it. Besides traditional causation, of a Newtonian and determinist basis, mention is made of another causation, quantum and probabilistic, and the fitting it could have within Criminal Law. On the other hand, reference is made to the objections that are raised by the precautionary principle in Criminal Law, by taking scientific uncertainty as a hypothesis on a causal occurrence. A brief look is taken in the important matter of determinism in human behaviour and it concludes with some reflections on the interdisciplinary method in Criminal Law.
