The purpose of this article is to give a new vision of the historical dualism between ius civile and ius honorarium. The roman lawyers have given different versions, each based on different perspectives, but none of them totally convincing. The principal conclusion of this article is that ius honorarium could have been the result of a jurisdiction based on equity.
