Protección Jurídica de la libertad religiosa en la República Dominicana

La República Dominicana reconoce en su Constitución el Derecho a la libertad de cultos y de conciencia, mas no la Libertad Religiosa. Sin embargo, la misma es protegida por los tratados internacionales sobre derechos fundamentales ratificados por la República Dominicana, lo que le otorga un rango constitucional, y por tanto, debe ser garantizada por el Estado. Todo dominicano y dominicana puede reclamar la protección de su derecho fundamental a la Libertad Religiosa mediante distintos mecanismos que analizaremos en esta pieza. En adición, estudiaremos como es protegida la Libertad Religiosa, la religión como bien jurídico y los sentimientos religiosos en las distintas ramas del sistema jurídico dominicano.

The Constitution of the Dominican Republic recognizes the freedom of worship, and the freedom of conscience, but it does not recognize the freedom of religion. Nevertheless, freedom of religion is protected in human rights international treaties signed by the Dominican Republic, giving this right a constitutional range, and therefore, the state must guarantee its protection. Every Dominican can claim the protection of their freedom of religion via the several mechanisms further analyzed in this piece. In addition, we will study how is the freedom of religion protected, the religion in the legal system, and the religious feelings in the Dominican law.
