¿Convalidación simple o sanación en raíz? la revalidación canónica del matrimonio civil de los católicos
Este artículo aborda la cuestión del matrimonio civil de los católicos y sus posibilidades de convalidación a efectos canónicos, a la luz tanto de la regulación codicial como de la casuística y la praxis eclesiástica. La autora advierte de las dificultades existentes para proceder a la convalidación simple, y sugiere un mayor recurso a la sanación en la raíz, y quizá también a la dispensa de forma.
This paper examines the issue of the civil marriage of Catholics and its possible convalidation under canon law, in the light both of the Code of Canon Law and the casuistry and ecclesiastical praxis. The author warns about the difficulties to proceed to a simple convalidation and suggests a more frequent use of the radical sanation, as well as, perhaps, the dispensation of canonical form.
