El derecho de los padres a elegir la educación religiosa de los hijos y transmitirles la fe como contenido del derecho a la libertad religiosa

Este derecho regulado en dos sedes diferentes, en el art.2.1c) LOLR y en el art. 27.3 CE, plantea el problema de si se trata del mismo derecho o, por el contrario, de derechos distintos. En un principio parecería que estamos ante el mismo, consecuencia de que en los dos preceptos la titularidad del derecho está vinculada a la de la patria potestad; no obstante, la clave de la cuestión radica en explicitar su naturaleza jurídica y, en concreto, si son derechos que persiguen satisfacer intereses propios de los padres o, por el contrario, funciones: derechos atribuidos a los padres para facilitarles el cumplimiento de los deberes educativos inherentes a la patria potestad. La solución que se de a esta cuestión va a conllevar importantes consecuencias jurídicas.

This right, which was regulated under two different pieces of legislation – article 2.1c) of the Organic Law on Religious Freedom and Article 27.3 of the Constitution – brings up the problem of whether we are dealing with the same right or two unconnected rights. It would at first glance appear that we are dealing with the same right; a consequence of the fact that in both cases the right is linked to that of parental authority. Nevertheless, the crux of the matter lies in defining their legal nature and, specifically, whether they are rights which aim to pursue the interests of the parents themselves or to fulfill certain functions; rights granted to parents in order to facilitate fulfillment of the educational responsibilities which are inherent to parental authority. Whatever the solution arrived at for this question, it will have significant legal consequences.
