El impacto de la confesión budista en el ordenamiento jurídico español

Este trabajo propone analizar el estado actual de la confesión budista en España, a raíz del reconocimiento de notorio arraigo en el 2007 por el Ministerio de Justicia. Dicho reconocimiento se hizo anteriormente extensible a los mormones en el 2003 y a los Testigos de Jehová en el 2006, lo que implica que el concepto de notorio arraigo quede, en la práctica, vacío de contenido. En esta ocasión, no se persigue reformular este término, aunque sí precisar que se haga, sino más bien exponer el camino seguido por la confesión budista hasta alcanzar el notorio arraigo y su repercusión en el actual Estado aconfesional. En cuanto a la metodología utilizada, partimos de un análisis retrospectivo del tema, desde el inicio de negociaciones hasta el momento de la concesión, con el fin de analizar después su situación actual y sus perspectivas de futuro. Por último, se establecen algunas conclusiones al tema.

This article will analyze the current state of the Buddhist confession in Spain, based on its recognition in 2007 by the Ministry of Justice as having “deeply rooted status”. Such recognition was previously extended to Mormons in 2003 and to Jehovah’s Witnesses in 2006, implying that the concept of “deeply rooted status” is, in practice, meaningless. At this moment reformulation of the term will not be discussed, although that is certainly needed, but rather an exposition of the path taken by the Buddhist confession faith in reaching the “deeply rooted status” and its impact on the currently secular State. Regarding the methodology here used, we will start with a retrospective analysis of the topic, from the beginning of negotiations up to the time of the grant, and later we will discuss its current situation and its future prospects. Finally, certain conclusions regarding the theme are established.
