Matrimonio homosexual y categorías jurídicas

Este trabajo critica alguno de los argumentos utilizados por el Tribunal Constitucional para sostener la constitucionalidad de la Ley 13/2005, de modificación del Código Civil en materia de derecho a contraer matrimonio. La inclusión del matrimonio entre hombres y mujeres en el núcleo esencial de la garantía institucional del matrimonio no impide el reconocimiento del matrimonio homosexual por el legislador, en la medida en que este no afecta al mantenimiento del matrimonio tradicional. Del mismo modo, el matrimonio homosexual no limita el derecho del hombre y la mujer a contraer matrimonio con plena igualdad, con lo que no tiene sentido, por tanto, examinar si el matrimonio de personas del mismo sexo infringe el contenido esencial de este derecho.

This paper criticizes some of the arguments used by the Spanish Constitutional Court to uphold the constitutionality of Law 13/2005, dated July 1st, 2005, which amends the Civil Code with respect to the right to marry. There can be no objection to include the marriage between man and woman in the essential core of the marriage as an institutional guarantee. It does not prevent the legal recognition of homosexual marriage because it does not affect the continued existence of traditional marriage. In the same way, homosexual marriage does not restrict the right of man and woman to marry with full legal equality. Then, it simply makes no sense to examine if same-sex marriage infringes the essential content of this right.
