Infracción al ordenamiento de la UE con la pena de alejamiento forzoso e ineludible a la víctima: Sobre la cuestión de prejudicialidad suscitada por la Sección 4ª de la Audiencia Provincial de Tarragona

Entre la cuestiones más interesantes y controvertidas que introduce el Tratado de Lisboa es el nuevo rol que ocupan los derechos fundamentales in el nuevo Derecho Europeo- Poco a poco percibimos que los derechos fundamentales van ganando terreno en las discusiones del alto foro. Esta situación de que el Tribunal de Justicia se pronuncie sobre una materia penal, era difícilmente concebible años atrás: la nueva era es avistada por la Audiencia de Tarragona quien se dirige al tribunal de Luxemburgo para que le aclare un problema penal.

Among the most interesting and controversial issues introduced by current European Union's Lisbon reform treaty is the position of the civil liberties in the new European Law. We can recognize that, step by step, the human rights are winning a main place in the labor of the Court. This event was very difficult to belief not very many years ago, but at his moment the European Court could pronounced about a criminal matter. This new situation was detected by the National Spanish Court of Tarragona who asks to the High Court if the national penalty could attack the right of the European Union.
