La concesión del estatuto de refugiado debido al riesgo de ser perseguido por motivos religiosos. Sentencia del Tribunal de Justicia de la Unión Europea, de 5 de septiembre de 2012, en el Asunto Y y Z

La sentencia del TJUE en el asunto Y y Z viene a ser el primer pronunciamiento de este Tribunal acerca de la concesión del estatuto de refugiado debido a persecuciones por motivos religiosos. De este modo, en la misma sentencia el Tribunal se pronuncia no sólo sobre el concepto de libertad religiosa recogido en la Carta de Derechos Fundamentales dela UE, sino también sobre los requisitos que deben cumplirse para que las injerencias en este derecho puedan ser consideradas actos de persecución, así como sobre los elementos a analizar para determinar la existencia de fundados temores. A la hora de realizar este análisis es tomada también en consideración la jurisprudencia del TEDH en materia de libertad religiosa y concesión de protección internacional en base a persecuciones por motivos religiosos, ya que constituye el fundamento de la interpretación del derecho recogido en la Carta.

The judgment of the ECJ in the case Y and Z is the first judgment in which the Court is pronounced about the grant of the refugee status because of persecution for reasons of religion. In this sense, the Court is pronounced in the same judgment about the concept of religious freedom established in the Charter of Fundamental Rights of the European Union, the necessary requirements to consider an interference with the right to religious freedom as persecution, as well as the elements that will determine the existence of well-founded fear of persecution. During this analysis it will be taking into consideration the European Court of Human Rights case-law about the religious freedom and granting international protection because of persecution for reasons of religion, since it is the basis for the interpretation of the right to religious freedom which is included in the Charter.
