Los efectos de la sentencia del caso Pizzarotti contra Comune di Bari. STJUE de 10 de julio de 2014

La Administración licita y adjudica un proyecto de obras que después no puede ejecutar por falta de financiación. La empresa adjudicataria pretende que se respete su derecho a la ejecución del contrato y el juez italiano le da la razón en primera instancia (2007). Ante la persistente inactividad, la empresa Pizzarotti recurre la no ejecución de la sentencia favorable y el Consiglio di Stato pregunta al Tribunal de Justicia si el cumplimiento del Derecho UE debe prevalecer sobre la cosa juzgada nacional.
