El sistema de responsabilidad ambiental. Estudio de su régimen y límites
En el presente trabajo se estudia el nuevo régimen de responsabilidad medioambiental introducido recientemente en el Derecho administrativo español. Se analizan las distintas técnicas introducidas para hacer efectiva la reparación ambiental, tanto desde el punto de vista de los operadores como de la propia Administración, a partir de los elementos estructurales del instituto de la responsabilidad y se realiza una valoración del nuevo sistema, comentándose los límites que el mismo presenta.
In the work there is studied the new regime of environmental responsibility got recently in spanish administrative law. The different skills introduced to make the environmental repair effective are analyzed, from the point of view of the operators and of the Administration. The analysis is realized from the structural elements of the institute of the responsibility, including a valuation of the new system and its limits.
