Plazos y preclusión procesal en el silencio administrativo
El silencio administrativo tiene como fin atribuir ciertos efectos jurídicos al vencimiento del plazo que genera el incumplimiento de la Administración Pública para resolver expresamente sus procedimientos y notificar al interesado dicha resolución. Estos efectos suponen la estimación, la desestimación o la caducidad del objeto sobre el que debía resolver y no lo hizo. La técnica del silencio es una garantía para el interesado, dado que, va poder acceder al recurso, sin que el transcurso del plazo para interponerlo conduzca a la preclusión, cuando la situación devenga de la inactividad de la Administración.
The administrative silence has the aim of attributing certain legal effects to the maturity of the term that generates the breach of the Public Administration to solve expressly his procedures and to notify the above mentioned resolution to the interested party. These effects suppose the estimation, dismissal or the lapsing of the object in which the Administration must resolve and they didn’t. The technique of the silence is a guarantee for the interested party, given that, the interested party will be able to apply for the appeal, without the course of the term to bring it leads to the maturity when the situation becomes of the inactivity of the Administration.
