Convenios con particulares: límites entre contrato, convenio y subvención

Dista mucho de ser clara la distinción entre contrato, convenio y subvención en las relaciones entre la Administración y los particulares.
No es infrecuente que se firmen convenios que, o bien encierran un objeto netamente contractual, o bien persiguen conceder una subvención. En cualquier caso, se burlan los principios generales de la contratación y de las subvenciones.
En las páginas que siguen se analiza la distinción entre las tres figuras a partir del derecho positivo y de la doctrina de los Tribunales y de las Juntas consultivas de contratación, al tiempo que se formulan propuestas de lege ferenda.

The distinction between contract, agreement and subsidy in the relations between the Administration and individuals is far from clear.
It is not uncommon for agreements to be signed, which either contain a purely contractual object or they seek to grant a subsidy. In any case, the general principles of contracting and subsidies are mocked.
In the following pages, the distinction between the three figures is analyzed from the positive law and the doctrine of the Courts and the Consultative Boards of hiring, at the same time that lege ferenda proposals are formulated.
