Discrecionalidad del Fiscal y flexibilización de la acción penal. El interés público en una administración eficaz de la Justicia

Este artículo considera el concepto de discrecionalidad del Ministerio Público como uno de los instrumentos más útiles para alcanzar algunos de los objetivos de la Administración de Justicia, tales como la efectiva rehabilitación del infractor y la pronta reparación de la víctima. La autora analiza la introducción de nuevas formas de justicia a través de la regulación de fórmulas alternativas a la acción penal que son administradas por el Fiscal, y su posible adopción en el seno de la Ley procesal penal española. Las fórmulas alternativas a la acción penal permiten enfrentar al infractor con el reproche social por la acción cometida sin la necesidad de someter al sujeto a un proceso penal convencional. Estas fórmulas alternativas no evitan totalmente la posibilidad del proceso, puesto que en caso de que la condición aneja no se cumpla, el infractor será procesado por el delito que originó la medida. La ideología que encierra la imposición de una determinada condición, es que con ello se asegura el modo más apropiado y efectivo de prevenir la reiteración y la reparación del daño producido a la víctima.

This article considers the concept of Public Prosecution discretion as the most useful tool to achieve some aims of the criminal justice system, as the rehabilitation of the offender and the reparation of the victim. The author examines the introduction of new forms of justice through the conditional cautioning that should be administered by the Prosecutor and their potential adoption by the Spanish Procedural Law. Conditional cautioning enables offenders to be given a suitable disposal without the involvement of the usual court processes. Where rehabilitative or reparative conditions (or both) are considered preferable to prosecution, conditional cautioning provides a statutory means of enforcing them through prosecution for the original offence in the event of non-compliance. The key to determining whether a conditional cautioning should be given –instead of prosecution- , is that the imposition of specified conditions will be an appropriate and effective means of addressing an offender behavior or making reparation for the effects of the offence on the victim.
