La protección de los Derechos Humanos en Europa: relaciones entre los Tribunales supranacionales y los Tribunales Constitucionales de los Estados

El autor aborda el problema de las relaciones entre los tribunales europeos supranacionales y los jueces internos en la interpretación y la aplicación de los derechos fundamentales. Sostiene la necesidad de una clara jerarquía entre las diversas fuentes y resalta que no se puede hablar de derechos humanos en sentido genérico, sino en relación con los textos normativos que los recogen. Los jueces nacionales deben tutelar los derechos humanos precisando las fuentes que aplican. Según el autor, las decisiones en esta materia no le corresponde a los tribunales, sino a los parlamentos nacionales, según las reglas del principio democrático.

The author focuses the problem of the relationship between the supernational european courts and the national judges in the interpretation and application of the fundamental rights. He stresses the necessity of a clear hierarchy among the different sources of law and remarks that it is not correct speaking of human rights generically, but only with a specific reference to the texts containing the rules referring to them. At the same time, the national judges should protect the human rights pointing out the sources of law which they do apply. According to the author, the basic choices in this matter are not of the courts, but of the national parliaments, following the rules of the democratic principle.
