Fundamentos doctrinales en torno a la tutela mulierum. Naturaleza y esencia de la tutela mulierum

La finalidad del presente trabajo es adentrarnos en el análisis de las diferentes posturas doctrinales que respecto a la naturaleza y funcionalidad de la tutela mulierum se han dado, abordando desde diferentes perspectivas, la difícil problemática que presenta una institución que ya desde su origen carecía de una clara justificación jurídica pero que en el seno de la sociedad romana arcaica mantenía su pervivencia por necesidad. Las razones esgrimidas por los juristas romanos para justificar la tutela del sexo fueron un mero intento por conciliar de un lado la rígida legislación promulgada respecto de la mujer, legislación iniciada por el propio Rómulo, y de otro, la artificialidad con la que se dotaba de contenido a una figura que desde los primeros momentos de la civitas mostraba signos de una involución forzosa.

The purpose of the present work is to go into in the analysis of the different doctrinal postures that have been given regarding the nature and functionality of the tutela mulierum, approaching from different perspectives, the difficult one problematic that presents an institution that already from its origin it lacked of a clear artificial justification but that in the breast of the archaic Roman society it maintained its survival from necessity. The reasons used by the Roman jurists to justify the tutela of the sex were a mere intent to reconcile of a side the rigid legislation promulgated regarding the woman, legislation begun by the own Romulo, and of other, the artificiality with which was endowed from content to a figure that showed signs of a necessary regression from the first moments of the civitas.
