Consideraciones sociales y materiales del duelo judicial en Roma. Sus posibles antecedentes indo-europeos

El presente artículo tiene por objeto un aspecto muy concreto de las pruebas no racionales: la búsqueda de los orígenes indoeuropeos del duelo judicial en la Roma antigua. Para ello, hemos considerado la historia del pueblo romano y de su cultura, no ab urbe condita, sino que nos hemos remontado a épocas anteriores y en las que hemos intentado buscar los elementos sociales y culturales que contribuyeron a la formación de la comunidad política romana en época pre y proto urbana y que pudieron justificar la existencia de un duelo judicial.

The present study takes as an object a very concrete aspect of the not-rational proofs: the search of the Indo-European origins of the judicial duel in the ancient Rome. That is why, we have considered the history of the Roman village and of her culture, not ab urbe condita, but we have gone back to previous epochs and in this we have tried to look for the social and cultural elements that they contributed in the formation of the political Roman community in epoch pre and proto urban and that could justify the existence of a judicial duel.
