Algunas cuestiones en torno a la verberatio
La “verberatio” constituye uno de los instrumentos ordinarios de la “coercitio” doméstica y militar. Con todo, una de las “leges Porciae” prohíbe sin ambages esta medida coercitiva cuando era aplicada a un civis, pudiendo el ciudadano, en tal caso “provocare ad populum”. En el supuesto de que fuese azotado un esclavo “contra bonos mores”, estamos en presencia de una injuria indirecta, ya que el esclavo no es el sujeto pasivo del ilícito, sino su “dominus” que es quien sufre realmente la afrenta.
