Algunos aspectos de la preocupación por la estética de los edificios públicos en el Derecho Urbanístico Romano

El trabajo que presentamos aborda el análisis y comentario de ciertas constituciones imperiales tardías de los siglos IV y V, en las cuales se prohíbe la transferencia de materiales constructivos y elementos ornamentales de unos edificios a otros. En efecto, la preocupación por la apariencia digna de las ciudades y la adecuada preservación de su estética fue una constante en el Derecho Romano desde tiempos muy remotos, pero aún se agudizó mucho más durante el Bajo Imperio. Prohibiendo la extracción, traslado y reubicación de piezas arquitectónicas, el legislador pretendía recuperar toda la belleza y esplendor de las ciudades antiguas, para conseguir lo cual, se establecen ciertas sanciones, culpabilizando a los poderes públicos y súbditos involucrados.

The work that we present approaches the analysis and commentary of certain imperial late constitutions of the IVth century and V, in which there are prohibited the transference of constructive materials and ornamental elements of a few buildings others. In effect, the worry for the worthy appearance of the cities and the suitable preservation of his aesthetics was a constant in the Roman law from very remote times, but still it sharpened much more during the Later Empire. Prohibiting the extraction, movement and relocation of architectural pieces, the legislator was trying to recover the whole beauty and brilliance of the ancient cities, to obtain which, certain sanctions are established, indicating the public power and involved subjects.
