President Obama’s first nomination to the Supreme Court: recent trends in the “advice and consent” procedure

On May 26, 2009, just few months after his election as President of the United States (US), Barack Obama had the opportunity to make his first nomination to fill a Supreme Court’s vacancy. His pick, judge Sonia Sotomayor, was confirmed by the Senate on August 6, 2009 and eventually became the 111th Supreme Court justice in US history. Taking inspiration from this recent event, the article reassesses the ‘advice and consent’ procedure that the US Constitution establishes to appoint justices of the Supreme Court, underlying the most recent trends that have characterized its employment. In particular, paragraph 1 will provide a short overview of the rules that govern the appointment process of US Supreme Court justices; paragraph 2 will describe the nomination of Justice Sonia Sotomayor and the scholarly criticism that have been recently raised against the practical functioning of the appointment process; some final remarks will follow […]
