El sistema de gobierno en las nuevas constituciones andinas: distribución horizontal del poder en el régimen constitucional de Venezuela y Ecuador
El presente artículo tiene por objeto, de una parte, el análisis general de ciertos condicionantes materiales que explican la problemática del presidencialismo latinoamericano y su evolución en el nuevo constitucionalismo andino y, de otra parte, el estudio de algunas de las soluciones que se han dado a esta problemática mediante la descripción de la organización político-institucional nacional y sus instrumentos de control horizontal en las constituciones venezolana y ecuatoriana. El artículo se estructura en tres apartados: el primero, analiza la activación popular en los procesos constituyentes y la crisis de la democracia representativa como elementos explicativos de algunas de las elecciones del constituyente; el segundo, describe la superación del esquema tripartito de funciones y poderes del estado en el constitucionalismo contemporáneo y la ruptura de las nuevas constituciones andinas con la estructura orgánico-funcional clásica; el tercero se centra en la descripción de la distribución horizontal del poder nacional en las Constituciones de Venezuela y Ecuador.
This article deals, on the one hand, with some material conditions that explain the problems of Latin-American presidentialism and its development in Andean new constitutionalism. On the other hand, the article describes some of the solutions to these problems in national institutional organization and accountability regulations in the Constitutions of Venezuela and Ecuador. The Article is divided in three parts: Part I, issues the crises of representative democracy and popular activation in constitutional processes as elements of explanation of some constituent choices; Part II, describes the end of three-branches scheme of separation of powers in contemporary constitutionalism and presents the national distribution of power in Andean new constitutionalism; Part III, focuses on describing national institutional organization and accountability in the Constitutions of Venezuela and Ecuador.
