Las medidas cautelares en el proceso penal de las personas jurídicas

En el presente trabajo se aborda el estudio del régimen cautelar aplicable a las personas jurídicas investigadas en un proceso penal. Tras delimitar el marco normativo, se analizan las medidas cautelares que pueden adoptarse atendiendo a la limitación que efectúa el art. 544 LECrim del que parece desprenderse la imposibilidad de adoptar medidas distintas a las previstas en el Código Penal. Exigencias prácticas y de efectividad del proceso penal exigen plantearse la posibilidad de adoptar medidas cautelares personales distintas a las previstas en la citada norma sustantiva, así como también medidas cautelares de naturaleza civil. Por otro lado, tras constatar la falta de regulación legal de los presupuestos de adopción se procede a delimitar el fumus boni iuris y el periculum in mora a través de las exigencias del principio de proporcionalidad. Respecto del periculum in mora se delimitan las situaciones que lo configuran y se presta especial atención al papel que pueden jugar los programas de compliance penal para evitar la adopción de medidas, así como para lograr su alzamiento o modificación una vez han sido adoptadas.

In this paper I examine the statuted regulation of precautionary measures that can be issued against corporations in criminal proceedings. After defining the regulatory framework, I analyze the precautionary measures that can be ruled based on the limitation made by article 544 of the Criminal Procedure Law. A literal reading of that provision leads to interpret that courts are banned of issuing other measures than those stated by the Criminal Code. Practical and effective requirements of the criminal process require considering the adoption of other precautionary both criminal and a civil in nature. On the other hand, after noting the lack of legal regulation of adoption requirements, the fumus boni iuris and the periculum in mora requirements are delimited through the demands of the principle of proportionality. Next, I define the shaping elements of the periculum in mora requirement. Special attention is given to the role that criminal compliance programs can play in order to prevent from issuing any measure against the prosecuted corporation, as well as to achieve their lifting or modification once they have been adopted.
