La partición practicada por el testador y la adjudicación de herencia existiendo legitimarios. Comentarios a la reciente doctrina de la DGRN

No estamos de acuerdo con la doctrina sostenida por la DGRN en recientes Resoluciones que cuando se trate de una partición realizada por el testador, en base al artículo 1056 CC, hayan de intervenir todos los herederos para manifestar lo que proceda respecto a la existencia o no de deudas de la herencia, pues de esta forma se obstaculiza, sin base legal alguna, la partición realizada por el testador, llamando para inscribir los inmuebles a favor del adjudicatario a todos los herederos, que es precisamente uno de los problemas que el testador pretende evitar realizando la partición. Tampoco estamos conformes con la exigencia de la intervención de los legitimarios en la partición practicada por los herederos, cuando a aquéllos se les dejó por el testador en pago de su legítima un determinado inmueble o a los que se les reconoció haberles satisfecho en vida su legítima por vía de donación y, todo ello, sin perjuicio de que los legitimarios puedan ejercitar por vía judicial las acciones que les correspondan para proteger sus derechos legitimarios.

We do not agree with the doctrine put forward by the Directorate General for Registries and Notaries in recent resolutions according to which, in partitions made by the testator under section 1056 of the Spanish Civil Code, all heirs have to be present to state whatever is relevant about the existence or nonexistence of debt inheritance. This hinders, with no legal basis whatsoever, the partition made by the testator by calling all heirs to the registration of the properties in the grantee’s favour, which is precisely one of the issues the testator seeks to avoid by making the partition in the first place. Nor do we agree with the requirement for the presence of the heirs-at-law in the partition made by the heirs if the testator already paid their (heirs-at-law) legitimate inheritance in the form of a property or an inter vivos gift. And this, not withstanding the right of the heirs-at-law to protect their legitimate rights by means of judicial proceedings.
