Los grandes defraudadores de tributos en la picota

Desde que el Gobierno, el 21 abril de 2015, pone en marcha el Anteproyecto de Ley Orgánica por la que se regula el acceso a la información contenida en las sentencias en materia de fraude fiscal, se ha suscitado un interesante debate en la comunidad jurídica y en la sociedad española. Si ponemos en un platillo de la balanza el incuestionable derecho al honor de las personas y en el otro, la imprescindible y neurálgica obligación de contribuir al sostenimiento de los gastos públicos, no hay duda sobre la prioridad de la decencia tributaria frente al honor perdido de los defraudadores. Quizá la única matización que cabe hacer al Anteproyecto pasa por eliminar la publicación de las sanciones en el Boletín Oficial del Estado, ya que eso dificultaría la cancelación de los antecedentes y el ejercicio del derecho al olvido.

The draft Organic Law regulating the access to information from judgements in tax fraud matters, adopted by the Spanish Government on April 21st, 2015, has given rise to a debate in the legal community and the Spanish society. If we weigh up the individuals’ unquestionable right to honour and the essential and key duty to contribute towards de payment of public expenditure, there is no doubt about the priority of tax decency over the lost honour of tax evaders. Perhaps the only qualification that could be added to the draft Organic Law is that it overrides the requirement to publish sanctions in the Official Gazette of the Spanish State, as this might hinder the deletion of criminal records and the right to oblivion.
