La intervención del notario en el matrimonio conforme a la nueva Ley de Jurisdicción Voluntaria

La Ley de Jurisdicción Voluntaria permite que los notarios tramiten el acta previa acreditativa de la capacidad para prestar consentimiento matrimonial y/o la escritura pública de formalización de dicho consentimiento (alguno de ellos o ambos). Mientras que la posibilidad de celebración del matrimonio entra en vigor a los 20 días de publicación de la Ley, existe un período de vacatio legis para la tramitación del acta previa matrimonial. Para tramitar dicha acta previa la Ley del Notariado impone atender a la Ley del Registro de 2011, cuyo actual desarrollo reglamentario es el Reglamento del Registro Civil de 1958. La interpretación de dicho Reglamento a la luz de la Ley de 2011 y su adaptación a la forma de actuación de los notarios, generan ciertas dudas interpretativas. Por ello es de esperar reformas legislativas en este período de vacatio legis.

Voluntary Jurisdiction Act entitles notaries public to process the preliminary official record supporting the capacity to give matrimonial consent and/or the public deed legalizing such consent (one of them or both). Whereas the possibility of conducting the marriage ceremony comes into force 20 days after the publication of the Act in the Official Gazette of the Spanish State, there is a period of vacatio legis for the processing of the preliminary official record. In order to process such record, the Spanish Notaries Act refers to the Registries Act of 2011, whose current regulatory development is the Civil Registry Regulations of 1958. The interpretation of these Regulations in light of the Act of 2011 and its adaptation to the Notaries’ public form of action raise some doubts. We can therefore expect legislative reforms during this period of vacatio legis.
