¿Existe el derecho a ser padre en solitario?

El deseo de ser padre sin mujer puede responder a distintas situaciones y opciones éticas, algunas de ellas de legitimidad difícilmente discutible. El fenómeno ya se está produciendo fuera de España, con amparo legal. No está claro entre nosotros su encaje constitucional pero hay fuertes argumentos para defender su legalidad. Por el momento sólo parece posible por la vía de la gestación subrogada fuera de España. Pese a algunas grietas jurídicas, la más reciente jurisprudencia intenta cerrar esa posibilidad, si bien, el debate social y jurídico está distorsionado por su entrecruce con el de los derechos de los homosexuales a la no discriminación. Este debate viene pretiriendo el dato de los derechos de los propios hijos nacidos al amparo de ésta y de otras técnicas de reproducción asistida.

The desire to have a child without a wife may respond to different ethical options and situations, some of them difficult to dispute. The phenomenon has a legal status outside Spain. Among us, its constitutionality is unclear, but there are strong arguments in favor of its lawfulness. For the time being, surrogate pregnancy is permitted only abroad. Notwithstanding legal cracks, recent jurisprudence intents to exclude such option, although the social and legal debate has been distorted due to its intertwining with the right of homosexuals to non-discrimination. Besides, in this discussion the rights of those children born through this and other assisted reproduction techniques are being ignored.
