Las obligaciones tributarias conexas han venido para quedarse

El pasado 22/9 el BOE publicó, finalmente, la Ley 34/2015, de modificación parcial de la Ley General Tributaria (LGT). Esta reforma incluye muy sustanciales cambios en las relaciones -siempre complejas- entre las distintas Administraciones tributarias y los contribuyentes que, no lo olvidemos, son -también aquí- ciudadanos y no súbditos. Sería hasta tedioso relatar aquí todos y cada uno de los extremos que esta Ley incluye pero, como síntesis, no es equivocado afirmar que introduce un claro sesgo favorable a las ya exorbitantes facultades de la Administración en detrimento de los derechos de los administrados, siendo paradigma de ello el régimen previsto para las obligaciones conexas en las que la presunción de legalidad de la actuación administrativa prima sobre la suspensión cautelar (manifestación obvia del fundamental derecho a la tutela judicial efectiva).

This 22nd of September, Act 34/2015, modifying partially the Spanish General Taxation Law, was finally published in the Official State Bulletin. The reform includes significant changes in the difficult relations between the different tax administrations and the tax-payers who, as we know, are citizens and not subjects. Describing each and every point the Act includes would be boring but, in summary, we can state that it introduces a clear bias towards the already exorbitant powers of public administrations at the expense of citizen´s rights. The regulation of related obligations, in which the presumption of legality concerning the administrative action prevails over the precautionary suspension, (an obvious expression of the fundamental right to an effective legal protection) is a paradigmatic case.
