La modificación del plazo general de prescripción de las acciones personales
En un lugar extravagante, como es ya costumbre de la legislación indecorosa de nuestro tiempo, se ha reformado el plazo de prescripción residual de las acciones personales, que se implanta ahora en cinco años. Cierto que el viejo plazo era demasiado largo. Pero, reconocido esto, todo lo demás en la reforma es un disparate. No sólo por la inconsistencia sistemática que crea la modificación puntual del art. 1964 CC, sino por la deficiencia intrínseca del nuevo texto legal.
In an inappropriate place, as is the custom of the unseemly legislation of our time, the default limitation period of actions in personam has been cut back to five years. It is true that the heretofore limitation period was immoderately long, but aside from this, everything else in the amendment is preposterous. This is so not only because of the systematic inconsistency brought about by the isolated alteration of art. 1964 of the Civil Code, but also by reason of the inherent deficiencies of the new legislative text.
