Cuestiones fiscales del divorcio extrajudicial
La Ley 15/2015, de 2 de julio, de Jurisdicción Voluntaria, contiene como novedad la posibilidad de divorciarse de mutuo acuerdo ante notario en escritura pública, ya en vigor desde el pasado 23 de julio. En el esquema tradicional los aspectos fiscales de las crisis matrimoniales eran distintos con o sin decisión judicial. El legislador no ha adaptado el sistema tributario a la nueva realidad del derecho civil, presumiblemente la omisión no ha sido intencionada. Una interpretación integradora y conjunta de la regulación civil y fiscal, sobre la base del interés del ciudadano objetivo de la Ley 15/2015, debería suponer que los aspectos fiscales de las crisis matrimoniales fuera comunes, ya sean judiciales o extrajudiciales.
The law 15/2015 of 2 of July of Voluntary Jurisdiction contains as a new measure the possibility of divorce by way of mutual agreement before a notary in a public deed. This measure has been in effect since 23 of July. In the traditional scheme, the tax aspects of the divorce were separate with or without a court decision. The legislator has not adapted the tax system to the new reality of civil law. Presumably the omission was not intentional. An inclusive and joint interpretation of the civil and fiscal law based on an objective view of Law 15/2015 must suggest that the tax aspects of marriage crisis were common whether judicial or extra judicial.
