Nombramiento de peritos en los contratos de seguro
El artículo 80 de la Ley Orgánica del Notariado regula el nombramiento de perito tercero por el notario, cuando los peritos de asegurador y asegurado no se ponen de acuerdo en la valoración del daño sufrido o en la cuantía de la indemnización, en los seguros de accidentes, de enfermedad o de asistencia sanitaria. El notario debe solicitar el nombre del perito de su Colegio Notarial, que lo extraerá de los listados que a principios de cada año deben remitir los diferentes Colegios o Asociaciones. Comunicado el nombre, el notario se lo comunica al nombrado para que acepte y, si lo hace, le remite la documentación para que emita su dictamen. Recibido éste por el notario, lo incorpora al acta y termina su actuación. Las partes quedan obligadas a aceptar la valoración contenida en el dictamen.
Article 80 of the law of Notaries regulates the naming of the independent expert by the Notary when the loss adjustors of the insurer and the insured are not in agreement on the valuation of the damage suffered and the amount payable in the insurance of accidents, illness or healthcare. The Notary must request the name of the expert from the College of Notaries which is drawn from the listings that the different Colleges and Associations must provide at the start of every year. The Notary must provide details of the named expert for acceptance and if accepted the documentation is provided to the expert for their opinion. This is incorporated into the notes of the Notary and concludes their work. The parties are obliged to accept the assessment contained in the opinion.
