La mora es aquella situación jurídica en que se encuentra la relación obligatoria cuando, vencido el término en el cual la obligación debía ser cumplida, el deudor no lo ha hecho y ha sido constituido en mora, a salvo los supuestos en que la intimación no es necesaria. Existen serias dudas doctrinales y jurisprudenciales respecto a si tipos que pueden estar entre el 19% y el 29% cumplen correctamente estas funciones, tipos que a la mayoría de los ciudadanos nos parecen excesivos. El Tribunal Supremo se ha pronunciado sin llegar a aclarar la cuestión quedando pendiente ahora la resolución del Tribunal de Justicia del Unión Europea.
Default in payment is the legal situation in which an obligation is not fulfilled by one party and a rate of interest may be applied to the outstanding. There are serious doubts as to whether the rates of interest applied which may be in the amount of 19% to 29% correctly fulfil the required function and may seem excessive to many people. The Supreme Court has delivered judgment on this but has not clarified this issue pending the decision of the Court of Justice of the European Union.
