Poderes extranjeros

Resumen de las conclusiones del Seminario de Derecho Privado celebrado en el Colegio Notarial para analizar la resolución de la DGRN de 14 de septiembre de 2016 en materia de poderes extranjeros. Esta resolución incurre en graves errores de forma y fondo cuya aplicación literal haría imposible la inversión extranjera en España. A este asunto es necesario aproximarse con la flexibilidad ya utilizada por la gran mayoría de los notarios, sin incurrir en rigideces apriorísticas que van a generar muchísimos más problemas que los que pretenden solucionar.

Summary of the conclusions of the private law seminar held at the Notary College to analyse the DGRN resolution of 14 September 2016 on foreign powers. This resolution includes serious errors of form and substance, the literal application of which would make foreign investment impossible in Spain. In this matter, it is necessary to approach the issue with the flexibility already used by the great majority of notaries, which will avoid the rigidity that would generate many more problems than those they seek to solve.
