El Concierto Económico del siglo XXI: nuevo cupo y ¿extensión a Cataluña?

El Concierto Económico con el País Vasco constituye un régimen muy peculiar de nuestro sistema tributario, que ha recobrado mucha actualidad, tanto por su cuestionamiento como por el reciente acuerdo sobre el Cupo y su posible extensión a Cataluña transformado en “Pacto Fiscal”, como fórmula de solución al grave contencioso con el Gobierno Central. El estigma de régimen privilegiado del Concierto, basado en sólidas razones empíricas, no afecta tanto al régimen como tal, como a alguno de los efectos generados por su funcionamiento, fundamentalmente debidos a la metodología y actualización del cupo, habiéndose perdido en mayo pasado una ocasión histórica para corregirlos, posibilitando su extensión a otros territorios. La implantación en Cataluña de un régimen similar, ya de por sí difícil, con el nuevo cupo se complica todavía más, al menos desde la perspectiva exclusivamente técnica.

The Basque Country’s Economic Agreement represents a special tax regimen in Spain, back on the spotlight due to questions regarding its existence, the recent accord concerning the Quota Laws (Leyes de Cupo, in Spanish), and also the possibility of the Agreement extending to Catalonia, thus forming a “Fiscal Pact” as a solution to the serious civil action against the Spanish government. The stigma surrounding regional advantages granted by the Economic Agreement, based on firm empirical reasoning, does not affect the Agreement so much unto itself, as much as it does the side effects created by the Agreement being in place. This is mainly due to the quota methodology and update, authorities having missed out last May on a historic opportunity to be rectify it, therein enabling the Agreement’s extension into other Spanish regions. Implementing Catalonia under a similar regimen, difficult within itself, is even more challenging with the new quota, solely from a technical standpoint.
