La intervención de los hijos mayores de edad en el divorcio de sus padres

En el divorcio de mutuo acuerdo tramitado ante el Letrado de la Administración de Justicia o notario, los hijos mayores de edad o menores emancipados deben prestar su consentimiento respecto de las medidas que les afecten por carecer de ingresos propios y convivir en el domicilio familiar. Esta exigencia legal, que no existe en el divorcio de mutuo acuerdo tramitado ante el juez, admite múltiples interpretaciones y puede crear inseguridad al no estar claro, en definitiva, qué es lo que los hijos mayores están consintiendo y para qué.
