Parece difícil de entender que, en una sociedad moderna, una medida de gracia como la concesión de indultos por parte del Ejecutivo se haya mantenido, casi intocable, desde 1870 -con el parón de la Segunda República-. Y que no se haya planteado una reforma a fondo, más allá de retoques puntuales, durante casi siglo y medio. Para que esta medida se aplique de forma efectiva, la reforma debe aclarar de forma inequívoca qué categorías del Código Penal incluye en el veto.
In a modern society, it is difficult to understand that a measure of clemency like the granting of pardons by the Executive has remained almost untouchable since 1870, apart from an interlude during the Spain's Second Republic. And that no thorough reform has been proposed, apart from occasional adjustments, for almost a century and a half. For this measure to be applied effectively, the reform must state unequivocally which categories of the Penal Code are included in the veto.
