La reciente sentencia del Tribunal Supremo 146/2018 de 15 de marzo ha abordado un supuesto de hecho frecuente y problemático en la praxis notarial: el testamento otorgado por persona con limitaciones en su capacidad de obrar. El alto Tribunal resolvió a favor de la validez del testamento. En este trabajo se comenta su contenido, a la luz de la doctrina jurisprudencial clásica sobre la cuestión, para concluir destacando su aportación fundamental que es el principio de presunción de capacidad reforzado por la Convención de Nueva York de 2006 y sus implicaciones en este y otros negocios jurídicos, estudiando la más reciente doctrina jurisprudencial sobre el tema en tanto actúe el legislador. La sentencia se valora positivamente, y supone una guía y un respaldo a la actuación del Notariado.

The recent ruling by the Supreme Court 146/2018 of 15 March addressed a frequent and problematic situation in notarial practice: wills made by individuals who have limitations in their capacity to act. The High Court ruled in favour of the validity of the will. This article discusses its content in the light of the classic jurisprudential doctrine on the issue, and concludes by emphasising its fundamental contribution, which is the principle of presumption of capacity reinforced by the New York Convention of 2006, and the implications thereof for this and other legal issues, and studies the most recent jurisprudential doctrine on the subject pending legislative action. The ruling is considered in a positive light, and it provides a guide and support in notarial proceedings.
