El derecho al olvido digital: otra vuelta de tuerca Ahora el Tribunal Constitucional

El derecho al olvido digital consiste en la facultad de las personas físicas de oponerse y reclamar la supresión de algunos de sus datos personales que figuran en Internet, procedentes fundamentalmente de hemerotecas digitales. Aunque hasta el Reglamento (UE) 2016/679 la ley no lo reconoció, se admitía jurisprudencialmente tanto en la Unión como en España, en base a la normativa general de protección de datos anterior a la implantación de Internet. La reciente sentencia del Tribunal Constitucional 58/2018, de4 de junio, lo consagra, utilizando la técnica de ponderación de derechos en conflicto, dando un paso más que el Supremo. Aunque no haya convencido ni a los partidarios de la libertad absoluta de información en la red ni a quienes consideran prevalentes los derechos declarados en el artículo 18 de la Constitución, resulta una sentencia equilibrada y de calidad.

The digital right to be forgotten consists of the power of natural persons to oppose and demand the suppression of some of their personal details that appear on the Internet, which mainly come from digital newspaper archives. Although the law did not recognise it until Regulation (EU) 2016/679, it was accepted in jurisprudence in both the European Union and in Spain, based on the general regulations for data protection prior to the introduction of the Internet. It is con-firmed by the Constitutional Court's recent ruling 58/2018of 4 June, which uses the technique of weighing of rights in conflict, going a step further than the Supreme Court. Although it has not convinced either the supporters of absolute freedom of information on the Internet, or those who believe the rights declared in Article 18 of the Constitution should prevail, it is a balanced ruling of high quality.
