El notario: de órgano preconstitucional a ¿poder legitimador?. El notario y los valores constitucionales

La función notarial no aparece mencionada en la Constitución, a pesar de su antigüedad. Su naturaleza híbrida y multifuncional la hace de difícil encuadramiento en los tres poderes constitucionales clásicos, al punto de que algún autor ha considerado la existencia de un nuevo poder, el legitimador. Esa misma naturaleza híbrida es la que hace difícil saber qué valores constitucionales des-arrolla básicamente el notario: se ha hablado de la dación de fe, del asesoramiento, de que es un órgano de control de la legalidad o un órgano de seguridad preventiva o cautelar. Pero el valor que mejor lo define es el dela libertad y autodeterminación del ciudadano.

Despite its age, the notarial function is not mentioned in the Spanish Constitution. Its hybrid and multi-faceted nature means that it is difficult to classify within the three classic constitutional powers, to the extent that some authors have argued for the existence of a new power, that of legitimation. The same hybrid nature makes it difficult to determine the constitutional values the notary basically implements: those discussed have included bearing witness, advice, being a body for the oversight of legality, and a body for preventive or precautionary security. However, the value that best defines it is that of the citizen's freedom and self-determination.
