Arrendamientos turísticos y de temporada

La regulación de los arrendamientos “turísticos” es competencia de las Comunidades Autónomas, conforme al artículo 148.18º de la Constitución, aunque muchos Ayuntamientos, con facultades cedidas por las mismas, o incluso sin ese requisito, tienen su propia Ordenanza al respecto. El cumplimiento de las normas administrativa es obligatorio para los “arrendamientos turísticos”, pues en otro caso las sanciones son bastante altas. En todo caso, si un piso no reúne los requisitos exigidos para ser “turístico”, a tenor de las normas administrativas, es evidente que se puede arrendar en concepto de “temporada” conforme el artículo 3.2 LAU. En el Real Decreto-ley 7/2019 se establece la posibilidad de que las comunidades de propietarios pueden prohibir los arrendamientos “turísticos”, sin efectos retroactivos, así como subir la cuota, por acuerdo de 3/5 de propietarios y cuotas, a tenor del nuevo artículo 17.12 LPH (en Cataluña 4/5 conforme al art. 553.2.2 de su propio Código civil, que regula el régimen de propiedad horizontal).

According to Article 148.18 of the Spanish Constitution, regulating "tourism" rentals is a competence of the country's Autonomous Regions, although many municipal councils, with powers assigned by the regional governments, or even without them, have their own Ordinance on the subject. Compliance with administrative regulations is mandatory for "tourism rentals," and failure to do so is subject to quite high penalties. In any event, if a flat does not meet the administrative regulations' requirements to be "tourist" accommodation, it can obviously be rented as a "seasonal" lease according to article 3.2 of the Urban Rentals Law. Royal Decree-Law 7/2019 states that owners' associations can prohibit "tourist" rentals, albeit not retrospectively, and increase the fees allocated to them, subject to agreement of 3/5 the owners and shares, according to the new article 17.12 of the Horizontal Property Law (4/5 in Catalonia according to article 553.2.2 of the region's own Civil Code, which regulates horizontal property).
