Libre elección de notario y préstamo hipotecario
El autor analiza el proceso de contratación de préstamos hipotecarios que impone la Ley 5/2019 y en especial respecto a la libre elección de notario. El proceso de contratación del préstamo hipotecario se ha visto obligado a cambiar a la luz de la contundente doctrina del Tribunal Supremo sobre la transparencia material que había dejado en el aire la validez y eficacia de casi todas las cláusulas incluidas en un contrato de préstamo hipotecario. A juicio del autor la LCCI constituye una nueva esperanza, pues regula el proceso de contratación de préstamos hipotecarios en coherencia con el moderno derecho de los consumidores. Y en la médula de ese proceso aparece la figura del notario, con su función de asesorar y garantizar el cumplimiento del deber de transparencia formal. Una figura, la del notario, imparcial y con especial atención a las garantías del consumidor.
The author examines the process involved in contracting mortgage loans imposed by Law 5/2019, and especially regarding the free choiceof a notary. The process of contracting a mortgage loan has been forced to change in the light of the overwhelming Supreme Court doctrine on material transparency, which called into question the validity and binding nature of almost all the clauses included in a mortgage loan contract. In the author's opinion, the Mortgage Contracts Law is a positive step, since it regulates the process of contracting mortgage loans in amanner consistent with modern consumer law. The figure of the notary is at the centre of this process, acting in an advisory role and ensuring compliance with the obligationof formal transparency. The notary is an impartial party, and pays particular attention to consumer guarantees.
