Una visión sesgada del artículo 34 de la Ley Hipotecaria

El autor analiza de manera crítica el artículo aparecido en Revista Jurídica de Cataluña, número 1-2018, págs. 9-40 escrito por F. P. MÉNDEZ que plantea una concepción artificial del requisito de buena fe que ha de reunir el tercero hipotecario para merecer la protección del artículo 34de la Ley Hipotecaria. A juicio del autor el artículo 34 de la Ley Hipotecaria ha venido prestando un ejemplar servicio a la seguridad jurídica combinando las garantías que exige el tráfico con el instituto de la buena fe que debe presidir toda la contratación entre particulares.

The author provides a critical analysis of the article published in the Legal Journal of Catalonia, number 1-2018, pp. 9-40, written by F. P. MÉNDEZ, which considers an artificial conception of the requirement of good faith that must be met by the third mort-gage to merit protection under article 34 of the Mortgage Law. In the author's opinion, article 34 of the Law has provided an impeccable service for legal security, by combining the guarantees required by legal traffic with the institute of good faith which must govern all contractual relations between individuals.
