Renuncia de la mujer al "senatusconsultum Velleianum"

A mediados del s. I d.C. surge el senatusconsultum Velleianum regulando que la mujer no garantizase las obligaciones de otros mediante la intercessio para no poner en peligro su patrimonio. En época posclásica, Justiniano realiza la última reforma jurídica en esta materia y establece como novedad la posibilidad que la mujer no se beneficie de este senatusconsultum si renuncia expresa y formalmente al mismo. En el presente estudio pretendemos demostrar que, con anterioridad a periodo justinianeo, la renuncia al mencionado senatusconsultum también pudo existir aunque de manera tácita, a tenor de la amplia casuística que muestra la Jurisprudencia clásica.

In the middle of the 1st century A.D the senatusconsultum Velleianum enacted that women were not allowed to guarantee anyone else’s obligations by the intercessio in order to protect their wealth. During the postclassic age, Justinian carried out the last legal reform in this area by establishing the innovative possibility that women do not benefit from this senatusconsultum if they relinquish it expressly and formally. In this present research, we aim to prove such renunciation also existed implicitly before Justinian’s age, according to the broad classic caselaw.
