Pandemia por coronavirus y contratos de arrendamiento propuestas de solución

La crisis sanitaria que estamos viviendo y el confinamiento de los ciudadanos establecido por el Real Decreto 463/2020, de 14 de marzo, tiene un impacto económico y social grave. Las relaciones de Derecho privado se ven también afectadas estas circunstancias y de las que más se habla es del impacto que en los contratos de arrendamiento puede tener una incapacidad de pago derivada del cese (obligado) de la actividad profesional dictado por las autoridades. El problema que se plantea es determinar quién soporta el riesgo del incumplimiento no culpable en los contratos con obligaciones recíprocas, es decir, cuando incumplo no por dolo, culpa o negligencia, sino que lo hago por caso fortuito o fuerza mayor (dejo de trabajar porque me obligan las autoridades que implantan el estado de alarma y no tengo ingresos). Este problema general se plantea en el contrato de arrendamiento de vivienda y en el de local de negocio (arrendamiento de uso distinto de vivienda) ¿Qué ocurre si el arrendatario no puede pagar la renta porque, tratándose de un local de negocio, se ha paralizado su actividad y no ha obtenido ingresos? Asimismo, se hace referencia a las novedades introducidas en materia de alquiler de vivienda habitual en el Real Decreto-ley 11/2020, de 31 de marzo, por el que se adoptan medidas urgentes y complementarias en el ámbito social y económico para hacer frente al COVID-19.

The health crisis we are experiencingand the confinement of citizens in accordance with Royal Decree 463/2020 of 14 March is having a severe economic and social impact. Private law relations are also affected by this situation, and one of the relations affected by these circumstances which is subject to extensive discussion is the impact that an inability to pay due to the (obligatory) cessation of professional activity dictated by the authorities may have on leasing contracts. The problem that arises is one of determining who bears the risk of a non-culpable breach in contracts with reciprocal obligations, i.e. when the breach is not a result of fraud, fault or negligence, but instead due to unforeseen circumstances or force majeure (e.g. having to stop working due to being forced to do so by the authorities implementing the state of alert and having no income). This general problem arises in housing lease agreements and in business premises contracts (leases for use other than housing). What happens if a tenant is unable to pay the rent on a business premises because his activity has been paralyzed and he has not obtained any income? The article also refers to the new provisions for rentals of main residences introduced in Royal Decree- Law 11/2020 of 31 March, which adopts urgent and complementary measures in the social and economic sphere to address COVID-19.
