El autor analiza los hitos legislativos en materia tributaria con motivo de la declaración del estado de alarman. El primer hito legislativo fue el Real Decreto-ley 7/2020 que, a pesar de anunciar pomposamente en su preámbulo medidas para paliar la crisis financiera de los empresarios, se limita a establecer la posibilidad de solicitar un aplazamiento -no fraccionamiento- de deudas tributarias con las siguientes condiciones adjetivas: (i) para empresas con facturación inferior a 6 millones de euros; (ii) por un plazo (innegociable) de seis meses; (iii) por deudas tributarias de hasta 30.000 €, en conjunto; (iv) perdonando los intereses devengados en los 3 primeros meses del aplazamiento y (v) permitiendo aplicarlo también a deudas por IVA, retenciones e ingresos a cuenta y pagos fraccionados. El segundo hito lo encontramos en el propio Real Decreto 463/2020 que establece el EdA, cuyas disposiciones adicionales 2ª a 4ª regulan, respectivamente, la suspensión de plazos procesales, de plazos administrativos y de plazos de prescripción y caducidad

The author examines the legislative landmarks in tax matters arising from the declaration of the state of alert. The first legislative landmark was Royal Decree-Law 7/2020, which despite ostentatiously announcing measures to mitigate the financial crisis for entrepreneurs in its preamble, merely establishes the possibility of requesting a deferment - rather than a payment in instalments - of tax debts with the following procedural conditions: (i) for companies with a turnover of less than 6 million Euros; (ii) for a (non-negotiable) period of six months; (iii) for total tax debts of up to 30,000 Euros; (iv) writing off the interest accrued in the first 3 months of the deferment, and (v) also allowing the deferment to be applied to VAT debts, withholdings and advance payments and instalment payments. The second landmark is in Royal Decree 463/2020 stipulating the state of alert, in which the additional provisions 2 to 4 regulate the suspension of procedural terms, administrative periods, and limitation and expiry periods respectively
