Se inicia el diálogo entre las jurisdicciones nacionales de más alta instancia y el Tribunal Europeo de Derechos Humanos

El 10 de abril de 2019 se ha iniciado el llamado “diálogo entre las jurisdicciones nacionales de más elevada instancia y el Tribunal Europeo de Derechos Humanos” que propugna el Protocolo número 16 al Convenio Europeo de Derechos Humanos de 1950. El trabajo, aparte de abordar las condiciones generales en las que se desarrolla el mismo, indaga en particular las consecuencias que se derivan de los dos dictámenes dados hasta el momento por dicho Tribunal en los que este ha perfilado el marco del ejercicio de su nueva competencia consultiva a efectos de que cristalice esa relación dialogal.

On April 10, 2019, the so-called “dialogue between the highest national jurisdictions and the European Court of Human Rights” that proposed Protocol number 16 to the 1950 European Convention on Human Rights has begun. This work, apart from addressing the general conditions in which it develops, inquires in particular the consequences derived from the two opinions given so far by said Court in which it has outlined the framework of the exercise of its new advisory jurisdiction in order to crystallize that dialogical relationship.
