D. 49.14: aportaciones de la jurisprudencia del principado en materia fiscal

Las líneas de acción de Septimio Severo y Caracalla para la consolidación de la dinastía mediante la centralización del poder imperial apoyado en el ejército y en el control de la administración estatal, supusieron la reorganización de la burocracia, el refuerzo del orden ecuestre y un importante incremento de los poderes jurisdiccionales de los funcionarios, con el consiguiente aumento de gastos administrativos y militares. La imposición de nuevas tasas y el aumento de los gravámenes existentes, junto a la definitiva absorción del erario por el fisco, perseguían la unidad de las finanzas estatales.
El nacimiento de un verdadero derecho fiscal y tributario exigió respuestas a cuestiones complejas, específicas y de actualidad a las que apenas se habían dedicados estudios jurisprudenciales. Por otra parte, las disposiciones normativas fiscales debían darse a conocer a la población de una forma sencilla y sistemática.
Bajo la rúbrica De iure fisci, D. 49.14, los compiladores recogieron un amplio catálogo de aportaciones redactadas en su mayoría por juristas severianos acerca del ius singulare desde un punto de vista material y procesal. Entre todas ellos, destaca la obra De iure fisci de Calístrato.

The main lines of action of Septimius Severus and Caracalla for the consolidation of the dynasty through the centralization of imperial power were supported by the army and in the control of the state administration. Those involved the reorganization of the bureaucracy, the reinforcement of the equestrian order and an important increase of the jurisdictional powers of the officials, with the consequent increase of administrative and military expenses. The imposition of new rates and the rise of current taxes, together with the final merge of Aerarium by Fiscus, searched for the unity of state finances.
The birth of a true tax law required the response to complex, specific and current questions to which hardly any jurisprudential studies have been devoted. On the other hand, tax regulatory provisions should be known by the population in a simple and systematic way.
Under the heading De iure fisci, D. 49.14, the compilers collected a wide book of contributions written mostly by Severian jurists about the ius singulare from a material and procedural point of view. Among all of them, the work De iure fisci by Calístrato stands out.
